1. Acceptance of Terms

By accessing or using Excitius ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes indicates your acceptance of the new Terms.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable laws
• You have not been previously banned or removed from the Service
• You will comply with all local, state, national, and international laws

3. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account
• Create only one account (no duplicate accounts)

4. User Conduct and Content

You agree NOT to use the Service to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload or transmit viruses, malware, or any other malicious code
• Collect or store personal data about other users without their consent
• Solicit money, passwords, or personal information from other users
• Use the Service for any commercial purposes without our written consent
• Engage in any form of harassment, bullying, or hate speech
• Promote or facilitate prostitution, sex trafficking, or any illegal activity
• Post content involving minors in any sexual or suggestive context
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers

5. Content Ownership and License

You retain ownership of all content you post on the Service. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, copy, modify, distribute, publish, and process your content in connection with operating and providing the Service.

You represent and warrant that you own or have the necessary rights to all content you post and that posting such content does not violate any third-party rights.

6. Premium Subscriptions

Excitius offers premium subscription features ("Premium Membership"). By purchasing a Premium Membership:

• Payment will be charged to your payment method upon confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You may manage your subscription and turn off auto-renewal in your account settings
• No refunds will be provided for unused portions of the subscription term
• We reserve the right to change subscription prices with notice

7. Listing Services

Our Platform allows users to post listings for services or companionship. You acknowledge and agree that:

• Listings must comply with all applicable laws in your jurisdiction
• We do not verify the accuracy of listings or the identity of users
• We are not responsible for any transactions, interactions, or arrangements made through the Platform
• Listings promoting illegal activities will be removed and may result in account termination
• You are solely responsible for the content of your listings
• We reserve the right to remove any listing at our discretion

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• At your request
• Unexpected technical issues or problems

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL INTERACTIONS WITH OTHER USERS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Excitius and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that you may assert claims in small claims court if they qualify.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified through the Service or via email. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
